My First 5-0 Encounter In The 5

Got bored at home tonight, decided to go for a drive.

Had been out for about 20 mins or so, driving through the centre of a local town and a copper was on the same road going the other way, drove past him at 30, keeping the revs low. He spots my front number plate, whips around at the round about and follows me. I'm stopped at a set of lights and he's behind, I pull off from the lights and he switches on the blues.

We both get out of the cars, he said he stopped me cos he wanted to check my front plate and he said my exhaust seemed a litte loud as if it was blowing, bare in mind I've got an axle back system on there with a 4" tip. So he checks the front plate and sees its legal, and then asked me about the exhaust, now I know for a fact its blowing on the flange, which I tried to sort the other day but didnt work, so was going to do it again tomorrow. I could've said no and he would've checked so I was in a catch 22, so I told him it had a slight blow and I had a new gasket on order for it.

Takes me in the car to check my details and make sure the car is mine, then tells me he's going to fill out a form with a ?30 fixed penalty for failure to maintain a silencer. Bit gutted to say the least, cos if it wasnt blowing I could've challenged that and he could've checked it and wouldnt have a had a leg to stand on as he couldnt pull the its too loud trick cos he had no db meter in the car.

But, I've looked around on the internet and found 2 websites that show the list of offences, and whether their servable with 3 points, prosecutable, verbal warning or vehicle defect note.

Failure to maintain a silencer comes under the dealt with defect note section, so am I right in thinking I shouldnt have had this ?30 fine, and just the defect note to get it sorted within 7 days and stamped?

I'm not quite sure what to do yet, I have a family friend that last time I saw her was a Detective Inspector for that duristiction, so I could well end up giving her a call lol

i got done ?60 for not wearing a seat belt and ?60 for doing 33mph in a 30 , they have had ?120 of my money and on the whole i think im a safe law abiding citizen . these type of fines must be generating sooo much money

Might be his discretion whether you get a fix or fine ticket.

I would have thought you would have been gitven one of those notice to fix it type things as you said to him that the part was on order. Seems a bit harsh ?30

Its friday night and he's pulling you over because he's bored and sees you in a flash car.

I just spoke to my dad who used to be a copper when he was young He said just say: "No i didn't know. I checked the car over this morning." Then he will say you need to get it fixed in 7days etc
the main thing you explained you had ordered a new part for the car, i mean what are you supposed to do not drive it around?

hes just a copper with nothing to do. any copper pulls me over they would have to have a really good reason.
My exhaust has a noise to it, but its not blowing. I would love to see the coppers face when he finds out I have never ever had a ticket, never been pulled over, no points etc and fully insured and taxed.

I see lots of cars and vans pouring blue smoke out and seen police drive straight past them, so annoying.

Yeah, I'm not quite sure where I stand now. The only option I have if I want to challenge it is to take it to court. I've got 28 days to pay it anyway, so I'm gonna do a bit of research first and see if I can find out what the situation is. I do agree that I should've had a defect note when I told him I had a gasket on order for it, PC Jobsworth strikes again!
If you take it to court its highly unlikely he'll show, not for something so minor anyhow. They rely on peeps just paying up.

I was popping down to see a friend of mine who was back from the army for a few days, silly muppet forgot to give me his old number and when I got to his, his car wasnt there, so I drove through town to head to the docks to see if he'd gone for a spin down there. He can come to me next time haha!

Yeah, I've had several people telling me today how they cant fine me for a mechanical problem with the car, it should be dealt with via defect note to be rectified within 7 days. I'm waiting on the advice back from a road traffic law specialist, so hopefully I'll know where I stand. If they say he's in the wrong and I shouldnt have the fine, I'll write to the head quarters of that duristiction explaining the situation and the legal advice I've recieved and see if they'll resolve it outside of court, not holding up much hope mind. But if they wont do anything and it goes to court, then it goes court, the only way I'll let it go to court though, is if I have legal advice saying I'm right and it should've been defect note, otherwise I'm just screwing myself over if they can fine me for it and I take it to court.

Time will tell, I've got 27 days left to pay it, so plenty of time yet lol

My mate (23 yrs old, owner of Audi S3) gets pulled over all the time, coppers trying to wind him up, do him for things he hasnt done, and all because he's got a nice car and nothing better to do.

Another mate who owns MX5 Mk1 had 1 brake light go out, pulled over same evening & told to fix it and check in future before setting off that everything was working (stand behind the car with foot on brake pedal - only if you are a certain Mr Tickle or a member of the fantastic 4...).

Point i'm making is they have far too much time on hands to annoy people / attempt to wind people up to fleece you for money. They dont stop vans with blue smoke and 0 brake lights in working order, just the flash cars who they think they may get money out of.

Get a written complaint to the station about the officer for harrassment, there was no need to pull you over by sounds of things. Waste some of PC precious' time, even if you do just get a standard response.

(p.s. i've never been pulled over but i'm waiting with bitten tongue at the ready!)

According to the legal advice I recieved, its their discresion whether they issue a 7 day slip, or fine.

So unfortunately, I have no option but to pay it

I've been pulled a few times now, once for my front palte, but although its not 'legal' as in doesnt have all the manufacturers stamps on it, its perfectly readable so they let me on my way.

The other one was for a brake light out, i fluttered my eyelashes and explained its very hard for me to check them on my own and noones ever around to check for me! He said 'well now you know, get it sorted!' Then let me go

Always best to play dumb in these situations.

You basically told him that the exhaust was leaking and therefore it fits with his reason for pulling you.

Not a nice thing to happen though and the copper is obviously a jobsworth. Such as life, most coppers are good and decent though. You just had a bad run in there.
True, when it doubt, play dumb. Police are very good at getting info out you in a round about way.. They know all the tricks.. Just unfortunate you obviously got stopped by a jobsworth probably having a bad day!
If I'd known it wasnt blowing, I could've played dumb, but I knew it was, so even if I'd said it wasnt he would've checked and I would've been screwed anyway, catch 22 unfortunately, I had to pay the fine in the end, so its all sorted now!
