ok gonna anyway lol.....

Hi,

I received the item this morning, however, it is not what was described in the auction.
I did not receive the silver metal roof clamps as shown in the picture, I received metal ones that have been spray painted black.
I have attached pictures to show that they are completely different to the ones advertised.
How do I go about getting the correct items that I purchased?

Regards,

to which I replied....

Hi,

These are the ones as in the picture, in the original picture from my advert they are black not silver. The colour was not stated as they are only available in black, however if you want them silver I can spray them silver for you if you return them to me and pay for the return postage back to you.

Many Thanks

Martin

He then replied....

Hi,

The picture in the advert clearly shows silver roof clamps, it was the main reason I bought them and not others available on eBay.
The picture showed the colour of the item so I would not have expected it to be stated in the advert.
Sending them back to you at my expense is not a fair solution, if you have misrepresented the item by posting a picture of a different item without stating it was different then the responsibility is yours.
I would expect you to either replace the item for the one in the picture at your expense or refund my payment including enough to cover returning the item to you.
I leave the option up to you.

Regards

Hi,

To be completely honest with you, If you look at the advert and the pictures you will see that they are the ones in the picture, The camera i used is my iphone so probably not the best, But looking at the pics they look lighter than black, infact if you look at the underside of the clamps and compare them to the picture you will clearly see that they ARE the ones stated in the advert.

If you are unhappy then i will accept these back but postage is at your cost. Which in the terms of ebay is fair.

I am really sorry for any problems this may have caused you.

If you are not prepared to accept that the ones in the picture are silver and reflective and are not the same as the black ones you sent me I have no choice but to raise a dispute with eBay, before I do I want to give you a chance to look at the picture on the listing again as it clearly shows a silver set of roof clamps. If this can't be agreed then I'll get eBay to mediate.

To which I replied..........

Hi,

I have spoken to ebay support this morning on 0845 355 3229, They have confirmed that offering you a refund as I have is 'doing the right thing' These ARE the ones in the pic please look at the underside of the clamps I have sent you and compare with the picture on my listing and you will see that they are the ones. I have been fair in offering you a full refund and will gladly take on any ebay appeal process. Also Its not like i have anymore of these available, I only had one set. I am sorry you are not happy with the item i sent you but there is not much more I can do about it but offer a refund.

Am I being fair?????

no but he has just said that he will now leave bad feedback and start a claim?  But i have offered him a full refund?? so his only gripe is that he will have to pay for the return postage.

I feel like posting up all his messages on here lol
